I still do not understand this. Karin Jansen gave orders for a search warrant which was supposed to be carried out a day after Paulus was arrested.
In another thread I have discussed this with posters and I was told it was supposed to be against the law that a search was done without the presence of a “rechter commissaris”. But in the Dutch law I can find no article claiming that a search warrant has to be done in the presence of a “rechter commissaris”.
|
He doesn't have to be present at all times anymore thanks to mobile phones. He can go for a cup of coffee somewhere.
If you want to know exactly don't bother with Dutch law because Pauls house is on Aruba.

In the discussion with other posters it appeared that the search warrant was restricted because the evidence, gathered without the presence of the “rechter commissaris, was supposed to be obtained unlawfull.
|
Evidence gathered by a search for which there are not enough documented facts and circumstances is unlawful. It is ultimately up to the RC to decide. He can make that ruling on the spot as part of the judicial oversight role the RC has over doorzoekingen.

|
It was restricted because not enough facts and circumstances were brought forward to justify it. If they knew for a fact that there was some evidence to be found, why on earth would the RC not allow them to go get it?

It does not make any sense that the search warrant was restricted two times. |
Then read again what Wit and Jorg had to say about it. Make sure you read the real one from Wit, not the fake one that says it was because he regularly sleeps at the vds place.

So family connections did indeed save the suspect. How could the legal system allow a judge to rule on a case when he stays at the suspects house?

He didn't stay in Joran's apartment.

A judge that has stayed with the suspects family would never had been allowed to make a ruling in the states. I guess that is ok in Aruba. After all its who you know!

That is why Joran had nothing to worry about. The judge was sleeping with the family!

Now we know why the suspects family got an extra 6 days before their place was searched. The judge had to move out his stuff. What would have happened if the OM or the cops saw the judges stuff in the appartment or house?

Just because a judge was there at the house does not mean he was staying at the house - is there a link to proof that he was LIVING THERE??

Dugo said he often stayed with the family. Is that fair? At least they should have brought in another judge. Just imagine what Greta would have said if she knw that?
