The death of a former suburban Chicago police officer's third wife has been ruled a homicide after a second autopsy showed she drowned, a prosecutor said Thursday.

The death of Kathleen Savio four years ago was initially ruled an accident. She was found dead in her bathtub shortly before her divorce with Drew Peterson was finalized.

Savio's body was exhumed late last year after he was named a person of interest in the disappearance of his fourth wife, Stacy. He has said Stacy Peterson ran off with another man, but her relatives deny any affair and say she was considering divorce.

"We have been investigating this as a murder since reopening the case in November of last year," Will County State's Attorney James Glasgow said. "We now have a scientific basis to formally and publicly classify it as such."

Peterson, 54, has denied any involvement in either case and he has not been charged with wrongdoing. He is a former sergeant in the Bolingbrook, Ill., police department.

Peterson told the (Joliet) Herald-News that the ruling in Savio's death shocked him. "You're kidding me. Unbelievable. That's hard to believe," he told the newspaper.

Authorities are not prepared to name a suspect in Savio's death, but police and a grand jury are actively investigating both cases, said Charles Pelkie, a spokesman for Glasgow's office.

Savio's family members said Thursday they always believed she had been killed and the confirmation was welcome. "But it could have prevented if people would have listened to her before she was killed." her niece Melissa Doman said.

Savio, 40, had filed an order of protection in 2002 after Peterson allegedly knocked her down, ripped off a necklace and left marks on her body. She wrote in the order that she feared Peterson could kill her.

Doman declined to say who she thought was responsible for Savio's death. She said she did not want to interfere with any current investigations or leads that authorities may have.

Peterson's attorney did not immediately return a telephone call Thursday from The Associated Press.

Pathologist declares Kathleen Savio’s death a homicide

JOLIET – Will County State’s Attorney James Glasgow announced today that his office has received the final report on the autopsy performed on the remains of Kathleen S. Savio on Nov. 13, 2007.

Dr. Larry W. Blum, the forensic pathologist who performed the autopsy, concludes in his report that the actual cause of Kathleen Savio’s death was drowning and that the legal manner of death was homicide. Dr. Blum’s report was delivered to the Will County Coroner’s Office on Thursday, Feb. 21, 2008 and immediately forwarded to the Will County State’s Attorney’s Office and the Illinois State Police.

“Dr. Blum’s forensic report renders his expert opinion that this is a homicide,” State’s Attorney Glasgow said. “We have been investigating this as a murder since reopening the case in November of last year. We now have a scientific basis to formally and publicly classify it as such.”

The complete autopsy report is a component of the investigation into the March 1, 2004 death of Kathleen Savio and will not be released. However, the Will County State’s Attorney’s Office and the Illinois State Police are releasing the following quote from the conclusion in Dr. Blum’s report:

“It is my opinion based on my education, training, experience and personal observations, and to a reasonable degree of medical and scientific certainty, compelling evidence exists to support the conclusions that the cause of death of Kathleen S. Savio was drowning and further, that the manner of death was homicide.”

This was the second autopsy performed on Kathleen Savio’s remains. The first was performed shortly after her death in March 2004. Her body was exhumed on the morning of Nov. 13, 2007, and Dr. Blum performed the second autopsy that afternoon.

In his report, Dr. Blum notes that he reviewed photos taken from the scene at the time of Kathleen Savio’s death as well as reports of the initial scene investigation. He also carefully examined the physical location of Kathleen Savio’s death on Nov. 20, 2007 as part of his investigation.

His report includes the results of microscopic examinations and toxicological tests conducted on postmortem tissue specimens. The specimens examined by Dr. Blum were collected during the first autopsy on March 2, 2004, the second autopsy performed by Dr. Blum on Nov. 13, 2007, and a third autopsy performed by Dr. Michael Baden on behalf of Kathleen Savio’s family on Nov. 16, 2007.

The results of those examinations and tests are part of the investigation and are not being disclosed at this time.

The Illinois State Police are investigating the murder of Kathleen Savio as well as the disappearance of Stacy Peterson. Kathleen Savio’s murder and Stacy Peterson’s disappearance are simultaneously being investigated by a Special Grand Jury that was convened in November 2007.

Wow, reading this just kind of takes my breath away. I'm not surprised at the results; it's just that seeing suspicions scientifically and formally supported is still a bit of a shock.

I'm very glad for Kathleen's family.

O.k. folks, here's a good question:
Since her death has been ruled a homicide BEFORE she was legally divorced from him, can the family get the divorce settlement officially
undone & make him give back to Kathleen's family?

Also, what status would this put the marriage of him & Stacy?
Would this make him a biggot?

I think he and Kathleen had children together, so I'm guessing they would be the beneficiaries of anything she had, not her parents/brothers/sisters.

Two of Kathleen Savio's siblings filed a petition in Will County civil court Thursday seeking to reopen the estate of their sister in preparation for a lawsuit against her former husband, Drew Peterson.

Savio's brother Henry and her sister Anna Marie Doman are "prepared to initiate a wrongful death cause of action against Drew Peterson on behalf of the estate of Kathleen Savio," the petition states.

Savio, 40, was found dead in a dry bathtub at her home in March 2004, her hair soaked with blood from a small gash on the back of her head. An autopsy determined the cause of death was drowning, and the medical examiner speculated that Savio -- who had numerous bruises on her body -- may have fallen in the tub and hit her head. A Will County coroner's jury ruled the death was an accident.

But from the time of her death, her siblings have voiced their suspicions that Drew Peterson, a former Bolingbrook police sergeant, was responsible for her death. Peterson and Savio were divorced, but still a few weeks away from a final settlement.

Savio's case garnered renewed interest from Will County authorities and state police investigators after Peterson's fourth wife, Stacy Peterson, vanished Oct. 28. Peterson has been named a suspect in her disappearance.

He has not been charged in either case and maintains he is innocent.

In November, State's Atty. James Glasgow filed a petition to exhume Savio's remains for a second autopsy, saying the circumstances of her death appeared to have been staged to conceal a homicide.

The Savio siblings' petition cited Glasgow's allegation as one of the reasons behind their request to reopen the estate. It also mentioned the findings of Dr. Michael Baden, a noted pathologist, who conducted a private autopsy on the remains in November and concluded Savio's death was a homicide.

And the petition noted statements made by Neil Shori, Stacy Peterson's pastor, who in December told Fox News' Greta Van Susteren that Stacy said she feared for her life and that her husband had killed Savio.

Drew Peterson said Kathleen Savio's family has not initiated contact with her children in years, and he dismissed the petition as an attempt by Savio's relatives to profit from her death.

"They're up to their money-grubbing tricks again," Peterson said, adding that the estate in question only amounted to $3,000. Savio, unbeknownst to her husband, took out a $1 million life insurance policy and named her sons as beneficiaries. That money is held in a trust and is not part of the estate, Peterson has said

John Q. Kelly, a New York attorney retained by the family, said Doman and her brother are not seeking money from the estate, but simply want their sister's two sons, now teenagers, to receive whatever money to which they are entitled.

"We're not satisfied everything was done properly, and we have a lot of questions that we want to get answers to for the sake of Kathleen's minor children," Kelly said. "This would be on their behalf. It has nothing to do with money for Anna or Henry."

The petition, filed by Joliet attorney Lawrence Varsek, asks the court to grant permission to Kelly to represent the family since he is not certified to practice law in Illinois

Doman and her brother seek to have themselves named to replace the executor of the estate, James B. Carroll. In the petition, Doman and her brother allege that Carroll, Drew Peterson's uncle, breached his duty to protect the interests of the estate by turning control of Savio's assets to her ex-husband.

"It appears there has been a lot of money that may have been earmarked to the two Savio children that may not have made it to them," Kelly said
.

The brother and sister also asked that their father, Henry Savio, not be named executor.

"He is unfit to serve due to hostility in that he has had no relationship with any of the children while they were growing up, including the decedent ... and first met his grandchildren at the funeral of Kathleen, and has no relationship with them," the petition stated.

A hearing on the petition was scheduled for Feb. 13

JOLIET -- Lawyers representing Kathleen Savio's family were in court for the first time Wednesday morning as they try to take control of her estate from Drew Peterson, her former husband, and one of his relatives.

But the hearing was brief.

Joliet lawyer Lawrence Varsek simply asked Will County Judge Carmen Goodman if they could return to court on March 17.

The parties involved in the case need time to organize various issues, he said

The judge quickly agreed.

The Savio family believes that all of Savio's assets should go to her children.

After her death, assets valued between $144,117 and $288,235 went to Drew Peterson instead
.

The family decided to try to reopen the old probate case after Drew Peterson's fourth wife disappeared.

Stacy Peterson, 23, hasn't been seen since the end of October.

Drew Peterson claims that she left him for another man, but her family disagrees. State police have called him a suspect in a case that might involve a homicide.

In March 2004, a neighbor found Kathleen Savio, 40, dead in the dry bathtub at her Bolingbrook home. At that time, Savio and Drew Peterson were divorced but still were fighting in court over money and other marital assets. A state police officer testified during Savio's inquest that foul play wasn't involved, and a coroner's jury determined she drowned accidentally.

A hand-written will later emerged.

It named James B. Carroll, Drew Peterson's uncle, as executor of the estate.

And in April 2005, a Will County judge entered a judgment in the financial aspects of the divorce case and gave some of the couple's assets to Drew Peterson

After Stacy Peterson vanished, state police decided to revisit the Savio case and her body was exhumed in November.

The new autopsy reports have been delayed by time-consuming and extensive toxicological testing.

Celebrity medical examiner Michael Baden also performed an autopsy shortly after the exhumation and determined that Savio was murdered.

Thanks so much for the info Gwen.

I hope & pray for her childrens sake that he did put the 1million in a GUARANTEED trust for them.

If he didn't I would say he's gonna be in big trouble.

Needless to say, the children are who's suffering.
You know that they miss their mom!!!

If nothing else happens, they definately deserve to know the WHOLE
TRUTH about her death. And rightfully so imho.

Former cop Drew Peterson, already under investigation for the disappearance of his third wife, shrugged off the news that a fresh autopsy has reclassified the woman's drowning death as a homicide.

"Unbelievable," Peterson said when a reporter for the Herald News in Joilet, Ill., told him of the ruling. "That's hard to believe
."

Peterson told the newspaper that he has made preparations to go to jail if police arrest him on charges concerning either of his wives.

"The thing is, do what you got to do," Peterson told the newspaper. "You roll the dice, I'll roll the dice."


The new autopsy concluded that Peterson's third wife, Kathleen Savio, died as the result of a homicide in 2004. She was discovered face-down in an empty bathtub with hair soaked with blood from an apparent head wound. Savio's divorce from Peterson was nearly complete at the time.


It was not clear exactly what new evidence emerged to change the coroner's cause of death from accidental drowning to homicide. It also does not name Peterson as a suspect in Savio's death.

"We have been investigating this as a murder since reopening the case in November of last year," Will County State's Attorney James Glasgow said Thursday. "We now have a scientific basis to formally and publicly classify it as such."

Savio had received an order of protection in 2002 against Peterson, alleging a pattern of physical abuse and threats.

Peterson, a duty sergeant for the Bollingbrook Police Department, was the first officer to respond to what is now considered a murder crime scene.

Savio's body was exhumed last November when Peterson, 54, was named a suspect in the disappearance of 23-year-old Stacy Peterson, his fourth wife and mother of two young children. She hasn't been seen since October.

Like Savio, Stacy Peterson had told family and friends that she feared her husband.

In November, when the state announced they wanted to reopen Savio's case, Peterson, a 29-year veteran of law enforcement, told ABC News that he would put more investigative stock in the first determination. "I put more faith in the first autopsy because it was fresh," he said.

Like Stacy Peterson's family, Savio's relatives have always maintained that the woman's death was not an accident. "I think we're happy its finally confirmed it's a homicide," Nick Savio, Kathleen's brother, said.

Drew Peterson remains the primary suspect in the disappearance of Stacy Peterson. He has kicked up controversy with a Web site soliciting money to pay his legal fees and as the suitor in a half-baked radio station dating game that was killed hours before it aired. But he's also maintained his innocence in the case, claiming that his fourth wife is alive and with another man. Authorities never have found a body.

And despite plenty of circumstantial evidence, prosecutors have not brought charges against the former cop.

But Drew Peterson may soon have another reason to defend himself.

At this late date, I am not holding out hope for it. I think the police will have to go after Drew for Stacy's death before they can convince a jury he killed Kathleen.

Maybe, just Maybe, the phone calls & cell phone records can be evaluated.
I think someone (Mark Furman) said the other night that the cell phone carrier they had ( Kathleen & Drew) should be able to verify to a certain extent & that the company
carries the records for seven years. If they get these records,
police can make a viable timeline as to what happened that night & next 36 hours.
Hopefully there will be enough to get whomever is responsible.
Don't think the boyfriend was around at the time of her death. Her sister said that Kathleen was alone she thought that night.
She also said that someone had to have been a good lockpick, or had to have had a key, or a garage door opener, because the were no signs of forced entry at the time.
My guess would be of the Drewpee, but who knows until they have the proof.

Yep. And the police know he has told lies. But, as in most cases, telling lies doesnt = arrest. I wish people would be able to see this, and stop asking why J2K havent been arrested for telling lies.

"I have a team of lawyers for that," he said. When asked about the return of the media outside the house, he said: "This is something that's come up, and it too will die down."

The former Bolingbrook police sergeant is a suspect in the disappearance of his fourth wife, Stacy, who was 23 years old when she vanished Oct. 28. On Thursday, autopsy results were released stating that his third wife's death was a homicide.


"I still don't believe it's accurate," Peterson, 54, said. "The thing is, everything will come out eventually."

On March 1, 2004, Kathleen Savio, 40, was found dead in the dry bathtub of her home in Bolingbrook.

Her hair was soaked with blood from a gash on her scalp, and she had bruises and abrasions on her body. The cause of death was drowning, and a coroner's jury at the time ruled it was accidental.

But on Thursday, Will County State's Atty. James Glasgow called the drowning a homicide after the results of a Nov. 13 autopsy were returned.

Authorities reopened the case after Stacy Peterson vanished, but stopped short of naming Drew Peterson a suspect in the homicide.

Peterson, who was just weeks from finalizing his divorce from Savio when she died, suggested the latest autopsy results are wrong.

He said he didn't believe her injuries were necessarily evidence of foul play.

"That bruising could have come from anywhere," he said. "Was she killed? Was that bruising from exercising? From wrestling with the kids?"

Peterson has not been charged with any crime and says he had nothing to do with either case.

But he said it's obvious that authorities view him as a suspect in Savio's death.

"I'm a suspect for everything," he said. "If Abraham Lincoln were killed a few years later, they'd be looking at me for that too."
