West Memphis Three heading to big screen

Dimension Films has acquired the Mara Leveritt book "Devil's Knot: The True Story of the West Memphis Three," and set Scott Derrickson and Paul Harris Boardman to pen the script, with Derrickson to direct.
Drama centers on an infamous Arkansas murder case that ended with the conviction of three teens based largely on their alleged fascination with the occult.
"Devil's Knot" reps a departure from Dimension's usual genre fare, and co-chair Bob Weinstein and president Richard Saperstein said it will be on a fast track to production.

Despite an outcry for a retrial and two HBO documentaries about the case that suggest plausible suspects were overlooked for political reasons, the three have remained in jail for more than a decade, including one who's on death row.
Elizabeth Fowler, Boardman and Clark Peterson will produce.
Genre films like "Amityville Horror" and Derrickson and Boardman's "The Exorcism of Emily Rose" regularly tie the phrase "based on a true story" to propel fictional horror storylines. The duo said "Devil's Knot" will stick to the facts.
"There is already a dark tone to the material, but we are absolutely committed to only telling the truth, and not exaggerating to entertain," Derrickson said. "We were very frank with Bob that this was the only way we'd make the movie, and he was right in line with us. We all understand the gravity, the high stakes of the situation, and the story is not over."

I know that all those fans of CSI out there will be shocked to learn this, but once in a while the creepy loser Goth kid really DOES kill somebody. The hicks vs. outsiders stuff plays really well in Hollywood, but the case really wasn't really all that complicated to begin with. Having said that, I don't think any of them needed the death penalty. I'm content for Damien to continue being the Belle of the Ball in the showers at Tucker for years to come.

Although I've agreed with you on some things, dogtownius, I disagree here.
It's not so much that the evidence against the WM3 is so compelling, it's that it's so anti-compelling.
The bloody Popeye's chicken guy, the goofy dad (stepdad?) and his mysterious dental work, shoddyshoddyshoddy police work? Too many red flags in this case.
These guys have spent ten years in prison. I don't think they're guilty of the crimes for which they've been convicted.

I have always had doubts about the guilt of these three. The very fact that the bugaboo of "devil worship" was used as a motive tells me that it's most likely a crock. Remember how "devil worship" and "satanic cults" were big boogeymen back in the eighties (and apparently in West Memphis into the nineties as well)? This would have been around the same time that aliens were mutilating cattle and every Halloween featured the horrifying rumor that a local (meaning wherever you were at the time) group planned to sacrifice a blonde haired, blue eyed girl on October 31st.
If you watch the HBO documentaries (especially the first), you will see that the father of one of the boys is much more likely to have been a threat, and should have been a suspect. His proximity to so many suspicious deaths is perplexing, to say the least.
Policemen will tell you that most murders are domestic, and 90% of murder victims know their killer. That a parent or neighbor molested and killed young boys is so much more likely than an organized "cult." Shades of Salem and Selma, if you ask me. . .

I grew up in Northeast Arkansas and have been connected, personally and professionally, to most of the major players in this case.
Over the years, I've gone back and forth over whether they did it or not. Perhaps with the movie coming out and this discussion started, people can help me out here.
For those who believe in their innocence, who is the most likely "real killer" and why/how was it done? I've heard claims that this person or the other might have done it, but only one group was found to have done so beyond a reasonable doubt.
For those who believe in their guilt, what about the evidence compels you to that conclusion? From what has been said over the years, there may remain some serious evidentiary questions.

These guys need a new trial. Now that the Satantic cult hysteria is gone and DNA testing has become more sophisticated, I think there are enough questions surrounding this case that justice would only be served by a new trial.

It's amazing to think these guys are still in jail when they are obviously not guilty.
For those still holding onto the original court's decision, you need to realize that as bad as you want somebody punished, the guilty party or parties are still at-large.

These three are guilty as hell.Jessie Miskelley confessed 3 times, twice after he was convicted. How many people do you know who would confess after they have been convicted. Damien Echols is a liar, hes a child murderer and a psychopath, Lorri Davis had to be out of her mind to marry him, or hard up. Mara's Book Devils Know is nothing but a fairy tale, like someone said Mara wasn't there.

I think this Hugh mann is as bad as the justice system. This whole case was corrupted and Iam damn sure the stepfather was the killer and the law is covering up for him and ,also believe all that convicted these kids for being different are just as bad as the murderer, and that they are all very hypocrticle in their religions.The Lord would never convict three innocent kids and most of all not put one on death row. If this country can convict someone because their different ,than that goes for most of the world. Iam sure each neighbor is different .That dont make them a murderer.They had no evidence so they make a case against innocent kids because they cant defend theirselves.Would they do the same to their own children if they were different.I really cant see how this jutice system can sleep at night. It shows you how they can cover up the real murderer and have the media work for them.You asked me eachone that had something to do with convicting these kids shouldnt have a job and should be the ones sitting in the cells for covering up the real murder .

It's about time they produce something that may actually inform America about the modern day witch hunt that happened in West Memphis back in 94'. I was 16 in 1994 and I remember the news meda back then and how messed up and quick people were jumping at the chance to find a killer. So I say more power to Mara for being able to be a researcher and dig up the facts. By the way Mara was at the trials she is even seen in Paradise Lost 2 interviewing Burk Sauls of WM3.org and the rest of the supports.

Just to let you know, I am an Arkansas native who knows many of the people involved.
Minnie, 19% of wrongful convictions include a false confession. Have you read the transcript of Jessie Misskelley's statement? It is the most inconsistant story ever told. I have studied this case throughly, and every time I go over the facts again I am amazed at the number of things wrong with this case and the handling. I dare someone to try and argue that the three are guilty based on the facts and evidence. I'll be sure to reply.

The movies made so far, along with this book, are fictional at best. Most of the true "facts" have been omitted or glossed over.
Take, for example, Damien Echols' MASSIVE mental health history. An imaginary friend named Rosey who was to help Damien, the second Christ, end the world and all people. Threats to cut his mothers' throat, to eat his father alive. Any doubts about his absolute insanity can be reviewed by seeing the "Dr. George Woods Affidavit", testimony used at Damien's appeal, seen here:

I don't think the "forced false confession" claim works when you consider this...
John Mark Byers has suffered for YEARS thanks to the two agenda-based movies made attempting to place a "guilty" spotlight on him. Not only did he lose his child to three horrific animals, he has had to endure his face and name plastered on the internet, along with people as far as Australia and the UK saying TERRIBLE things about him. Just imagine. You thought the Ramsey's had it bad over the Jon Benet case? Shame on the two film makers who created a life of HORROR for him and his family, and the other families who have suffered for years the outright lies and accusations of thousands of misled sheep. They are not allowed to have peace knowing that the three murderers of their little boys are where they belong, thanks to Devils Knot and the Paradise Lost movie makers.
Instead, they live day to day with accusations and questions flung at them, the praise HEAPED upon three vicious child murderers, knowing that all of this is due to two movies and one book.
If Paul Harris Boardman and Scott Derrickson choose to make a movie, I pray that it will, for the first time, show this case in a TRUE light. These families and this community have suffered enough.
My advice? Get the FACTS of this case before you spurt accusations. And the only way to do that is RESEARCH.

I dont remember seeing her in court and I was there EVERY day....hummm I guess maybe if some people dont really know the facts they can just make up what makes them feel all warm and fuzzy and to believe what ever makes a good story....sad

I think, if it's the same one I saw in a review, that Michael Pitt (Brad's brother) will play Damien... the same actor who played Kurt Cobain in Last Days, which I believe was a too Courtney-promoted film. But he is a good actor!

Baldwin lawyers fire salvo of papers allegations:
State withheld evidence

LITTLE ROCK — On the eve of a court-ordered deadline, defense attorneys for Jason Baldwin - one of three men convicted 15 years ago of killing three young boys in West Memphis - fired a new volley of allegations Thursday in separate filings at the Arkansas Supreme Court and the Craighead County Circuit Court.
In the Supreme Court filing, attorneys contend that prosecutors withheld material evidence from the defense teams representing Baldwin, then 16; Damien Echols, 18; and Jessie Misskelley, 17.
In 2007, six forensic pathologists and odontologists hired by defense attorneys concluded that the three 8-year-old victims - Steve Branch, Michael Moore and Chris Byers - suffered injuries caused by animals preying on the boys’ bodies after death.
Prosecutors had argued during Echols and Baldwin’s trial that the wounds were inflicted by a knife during satanic and sexual rituals. Those two were tried together; Misskelly was tried separately.
In Thursday’s filing, defense attorneys say they recently learned that during the murder investigation, West Memphis police consulted with San Diego police about the possibility that animal predation had caused the injuries.
If the state considered animal predation a possible rea-son for the children’s wounds, the state should have made that known to Baldwin’s trial attorneys, the defense’s court filing states.
Defense attorneys also argue that prosecutors failed to provide Baldwin’s defense with information about the survival knife shown to jurors as the murder weapon.
A law enforcement dive team found the knife several months after the murders in a man-made lake at the Lakeshore Trailer Park in Marion, where Baldwin lived with his mother and his brothers.
“Although no witness was presented to the jury to provide that information, the state argued this knife matched some of the wound patterns on the victims’ remains, making the issue of timing logically explicit: the knife must have been tossed into the lake after the killings,” the documents state.
Post-conviction investigations turned up two witnesses who told police that a large knife was thrown into the lake before the murders, attorneys say. And a police officer indicated that divers were given precise instructions as to where to find the knife.
Again, the defense says, if officers or prosecutors knew that the knife had been tossed into the lake before the killings, they should have shared that information with Baldwin’s team.
Thursday’s filing also questions the reliability of prosecution witness Michael Carson, housed with Baldwin in the Juvenile Detention Center for seven days before the trial. Carson testified that Baldwin told him he had dismembered the boys and sucked the blood from their genitals.
Since Baldwin’s conviction, however, defense attorneys have learned that Carson continued to act as an informant after leaving Arkansas. Even while living in California, he often sought advice and assistance from Arkansas authorities, the defense says.
The defense has since located all the staff and detainees who would have been at the juvenile center with Baldwin and Carson. No one else heard Baldwin say anything about the boys’ deaths, attorneys say. Records indicate that Carson and Baldwin were togetheronly once for any length of time. A staff member present on that occasion has signed an affidavit saying nothing was said about the murders.
Another staff member told defense investigators that law enforcement officers instructed her to take a leave of absence around the time she might be called as a defense witness.
The last issue addressed in Thursday’s Supreme Court filing pertains to genetic material found on the victims’ clothing. During the trial, a scientist testified that “it is most likely that the DNA we were detecting did come from sperm cells.”
This testimony aided prosecutors in their argument that the murders were sexually and satanically motivated.
If the defense team had been provided lab notebooks and notes in the file, they would have seen a report from the state Crime Laboratory that stated: “No semen was found on any items,” the defense filing states.
Baldwin’s attorneys also were not given notes from one criminalist who had written that the genetic material may have been contaminated by bacteria from the water. This, according to his notes, could have caused sperm tests to show a positive reaction.
In the Supreme Court filing, a petition for a writ of error coram nobis, attorneys are asking the high court to give the trial court authority to consider facts not known at the time of trial - through no fault of the defendant.
In Craighead County Circuit Court, defense attorneys filed anAmended Petition for Relief under Rule 37, alleging that:
Baldwin didn’t have a fair and impartial jury because jurors continued to read about the case and considered Jessie Misskelley’s confession during deliberations, even though that confession was not admissible at Baldwin’s trial.
Prosecutors withheld information regarding the knife, then committed prejudicial misconduct by conducting a demonstration with a grapefruit during closing arguments.
Baldwin’s defense failed to prepare adequately for the case, didn’t interview numerous possible witnesses who could have accounted for Baldwin’s whereabouts and activities on the days in question, should have challenged Carson’s credibility, and should have encouraged Baldwin to testify.
Defense attorneys for Baldwin and Misskelley could file more documents today. None of the attorneys could comment on the case because Craighead County Circuit Judge David Burnett forbade them from speaking to news media.
Burnett has tentatively set a three-week court session in September and October to hear appeals regarding new DNA evidence.
Echols was sentenced to die and remains on death row. Baldwin and Misskelley received life sentences.

JONESBORO - Lawyers for Jason Baldwin, one of three teenagers convicted of the 1993 slayings of three West Memphis second-graders, say some witnesses who could have exonerated their client should have testified at his trial.
The defense filed numerous affidavits in Craighead County Circuit Court on Friday to support their argument Baldwin's 1994 capital murder conviction should be either vacated or he should be given a new trial in light of DNA evidence they obtained last year.
The affidavits provide details on Baldwin's actions and whereabouts the day Steve Branch, Michael Moore and Chris Byers were killed.
The defense also filed a writ with the Arkansas Supreme Court on Thursday, claiming prosecutors withheld evidence from Baldwin's trial attorneys. In addition, they amended a petition for relief that claims numerous errors were made in the case, including improper deliberations by the jury and prosecutorial misconduct.
Friday's filing claims trial lawyers bungled Baldwin's defense by failing to call key witnesses and by not hiring a private investigator. It also requests a new trial under the state law that allows anyone convicted of a crime to ask for a re-examination of the evidence if new tests or science become available.
Baldwin, who was 16 at the time of the slayings, was sentenced to life in prison without parole. Co-defendant Damien Echols, then 18, was convicted and sentenced to death. Jessie Misskelley, then 17, was tried separately, convicted, and sentenced to life plus 40 years.
In April, Judge David Burnett met with prosecutors and defense lawyers representing all three defendants. Burnett set an Aug. 20 hearing to plan out a three-week schedule in September to take up the defense arguments. Burnett ordered lawyers in the case not to talk to the news media.
Lurid details and accounts of Satanism filled the original trials. Police found the bodies of the boys a day after they disappeared from their quiet, tree-lined neighborhood May 5, 1993. Their hands bound to their legs by shoelaces, the boys showed signs of suffering severe beatings before being left in a drainage ditch.
Friday's filing refers to witnesses the defense says were intimidated into silence or were never called by the defense.
Baldwin's art teacher, Sally Ware, said in an affidavit a school administrator suggested she would lose her job if she went to authorities to tell them Baldwin had been in school the day of the murders.
Other affidavits outline Baldwin's day May 5, 1993, saying he boarded the school bus and arrived at school as usual, that he mowed his uncle's yard when he got home, then went to Wal-Mart to play video games, that he was home by 9 p.m., and that he spent the night talking on the phone with friends.
In an affidavit, Joyce Cureton, who oversaw the juvenile jail, said former Craighead County Sheriff Larry Emison essentially told her not to testify. LITTLE ROCK — Jason Baldwin's 1994 capital-murder trial lacked numerous witnesses who could have played a pivotal role in his defense - from the art teacher who could have given him an alibi to the juvenile-detention supervisor who says the sheriff ordered her out of town to avoid testifying, according to documents filed Friday in Craighead County Circuit Court.
Baldwin's current defense team filed a 1,500-page writ of habeas corpus and exhibits, petitioning the court to either vacate his conviction or grant him a new trial in light of new DNA evidence obtained in the past year.
On Thursday, his attorneys filed a different writ with the Arkansas Supreme Court that claims prosecutors withheld crucial evidence from Baldwin's trial attorneys. They also filed an Amended Petition for Relief under Rule 37 that claims a multitude of errors, including improper deliberations by the jury and prosecutorial misconduct.
Friday's filing says trial attorneys bungled Baldwin's defense by failing to call key witnesses and by not hiring a private investigator. It also requests a new trial per the state's DNA law, which allows anyone convicted of a crime to ask for a re-examination of evidence if new tests or science have become available.
Baldwin, who, at age 16, was the youngest of the three teenage defendants, was convicted and sentenced to life in prison 15 years ago for the murders of three 8-year-old boys: Steve Branch, Michael Moore and Chris Byers. Baldwin and Damien Echols were tried together. Echols, then 18, received a death sentence. Jessie Misskelley, then 17, was tried separately, having given policea confession that would later be deemed inadmissible in the other boys' joint trial.
The trials and convictions gained national attention at the time because of the lurid allegations of satanic and sexual rituals involved in the murders.
'I WANT TO GET IT OVER WITH'
Over the years, the three defendants have attracted an international following of people and celebrities who believe that the investigation and resulting trials were flawed. The intense scrutiny has long irritated prosecutors and state officials, who contend justice was served.
In a court hearing this spring, Craighead County Circuit Judge David Burnett ordered all involved in the case to quit talking to news media before appeals hearings scheduled for the fall.
"I'm tired of reading about this case in the newspapers and seeing it on television," he said as he took the bench April 15. "I'll find you in contempt of court if I see any news account that attributes [information] to an attorney."
The judge also expressed frustration with the repeated questioning of the men's convictions. "This has been going on 15 years.I want to get it over with."
The case gained new momentum in the past year as the results of new DNA testing emerged.
Those results were noted in Friday's filing, the most significant being the lack of DNA found at the crime scene or on the victims' bodies. Defense attorneys contend that if one adheres to the state's theory that the children were killed in a bloody, satanic, sexual ritual, DNA from the defendants would have to have been left behind.
The filing refers to the findings of six scientists, all of whom agree that the boys' injuries were caused by animal predation after death - not a knife, as prosecutors argued at trial.
Also at issue are two hairs that appear to link Terry Hobbs, the stepfather of one of the boys, to the crime scene. In June 2007, after DNA results began appearing in the news media, the West Memphis Police Department asked Hobbs to go in for another interview. He denied any involvement in the murders - to detectives, and, later, to the Democrat-Gazette.
In Friday's filing, the defense points again at Hobbs, citing aninterview with a woman he dated for six months in 2002-03. The woman said Hobbs told her that he was the first to find the boys' bodies but didn't tell the police or his wife about his discovery.
"That's so crazy," Hobbs said Friday when asked about her claims. "Some people will say anything to get their 15 seconds of fame, and that, to me, sounds like one of those people."
The woman, he said, wasn't a girlfriend. She was interested in him, but he didn't reciprocate.
"And no," he added. "I didn't find the boys' bodies."
WHAT THE JURY DIDN'T HEAR
In Friday's filing, defense attorneys repeatedly refer to witnesses who they say either were intimidated into silence or were never called by the defense, despite having shared information with Baldwin's attorneys before trial.
In one affidavit, a potential witness said former Craighead County Sheriff Larry Emison threatened her.
Joyce Cureton oversaw the Juvenile Detention Center in Jonesboro, where Baldwin was held before and during his trial. Before trial, defense attorneys contacted her, hoping her testimony would help discredit one of the prosecution's star witnesses - a juvenile inmate, Michael Carson, who claimed that Baldwin told him that he dismembered the boys and sucked blood from their genitals. Cureton also could have authenticated records showing that Carson and Baldwin appeared to have been alone together on only one occasion. Defense attorneys also wanted her to attest to Baldwin's gentle nature and good behavior at the facility.
In her affidavit, Cureton said: "The then-sheriff, Larry Emison, instructed me to get out of Craighead County immediately. He told me I better not be in court."
Cureton says she obeyed, leaving for Newport with her husband.
"I regretted leaving town to avoid testifying at Jason's sentencing," she added. "I would not have left if the sheriff had not instructed me to do so."
Emison did not return a call for comment Friday.
Additional affidavits from numerous detention center staff members and former inmates support Cureton's assertion that Carson lied about Baldwin bragging about the killings.
All say that Baldwin refused to talk about the case and repeatedly denied any involvement. Former employees, relying on old records and logbooks, say Baldwin and Carson once played cards together, but nothing was said about the murders. Former inmates who were in that game also deny that Baldwin offered a confession.
None of these people were called to testify in 1994, and neither was Danny Williams, who worked for Recovery Way, a support program for troubled teens.
Shortly before the trial began, Williams, who had worked with Carson in the past, encountered the young man on Main Street, he recalled in an affidavit. Carson told him he was going to testify against Baldwin. Williams immediately thought back to a session with Carson in which he told the teen that if he didn't shape up, he would "end up in detention with the sorts of persons who had mutilated bodies and cut the scrotums off of little boys." At that time, he says, he shared some of the details of the case with Carson.
When Williams heard Carson planned to be a witness, he called Baldwin's defense attorney, Paul Ford.
"My concern was that I did not want to have caused a situation in which a young man that I viewed as troubled and not credible ... might be professing to have knowledge that he, in fact, may not have acquired in the manner that he was claiming to have acquired it," Williams explained in his affidavit.
Soon after he talked to Ford, a law enforcement officer showed up at Williams' house with paperwork that appeared to be either an order or a subpoena, Williams said. He then met with Craighead County Prosecuting Attorney Brent Davis, who appeared to be upset that Williams had contacted the defense.
The prosecutor seemed to agree that Carson had fabricated stories in the past. Still, Williams said, as he tried to explain to Davis why Carson wasn't credible, Davis was trying to explain that he was. Williams left feeling evenmore disturbed, he said.
"I was concerned that because I had spoken up in regard to this situation with Michael Carson, Mr. Davis felt that I was out of line."
Ford, Williams said, prepped him for trial, but then never called on him to testify.
"I never understood why I was not called to testify. After the conclusion of the Baldwin and Echols trial, I wrote a letter to Jason Baldwin expressing regret about the situation generally."
Sally Ware, Baldwin's art teacher, also lost a chance to take the stand.
Even as Baldwin's mother presented detectives with his attendance records from school - which showed he was there on the day the boys disappeared - Ware was asking Principal Wood of Marion High School if she should tell police that Baldwin had been at school on the day in question.
(In his confession, Misskelley said he, Baldwin and Echols killed the boys at 9 a.m., May 5, 1993. He later changed the time to noon.)
"Mr. Wood responded that I would not be much good for Jason if I were fired. My understanding was that Mr. Wood was letting me know that I would not have a lot of credibility if I were fired from my job. As a result, I did not go to authorities or anyone else."
Numerous witnesses, all of whom signed affidavits included in Friday's filing, say Baldwin boarded the school bus as usual on May 5, arriving at school by 8 a.m. When he got home, he mowed his uncle's yard, then went to Wal-Mart to play video games. He was home by 9 p.m. and spent the night talking on the phone with several friends, all of whom signed affidavits for Friday's filing.
After Baldwin's arrest, his mother arrived at the police station with his attendance records.
"I've got proof Jessie Misskelley was lying," she told a detective, whose interview was part of Friday's filing. "That can't be true. If [Baldwin] was in school, it cannot possibly be true."
The detective replied: "If we can prove that's where he was, I'm more than willing to see him be a free man."

Fifteen years ago, three teenagers were arrested in connection with the gruesome murder of three little boys.
Tuesday night supporters of the West Memphis Three gathered for a candlelight vigil in Riverfront Park for their release from prison.
The group spent 15 minutes in silence; one minute for each year Damien Echols, Jessie Misskelley and Jason Baldwin have spent locked up.
Capi Peck who helped organize the event says tonight all they want is justice to be served.
"We're here to remember the 15 years," Peck said. "Not just for the wrongfully convicted men, but for the victims as well and raise awareness in Arkansas about the injustice in our home state."
The three men have been in the spotlight again lately because of new DNA evidence being submitted in court.
The filing for Jessie Misskelley's re-trial will be filed on Friday.
