PHOENIX — Rap star DMX was arrested on Friday on suspicion of drug possession and animal cruelty after two searches of his home allegedly turned up weapons, drugs, dog carcasses and abused pit bulls.

The Maricopa County Sheriff's Office said DMX, 37, whose real name is Earl Simmons, initially barricaded himself in his bedroom when officers arrived at his home at 3 a.m. He eventually surrendered without offering further resistance.

"We are handling this case as we would any other incident of alleged animal cruelty," Maricopa County Attorney Andrew Thomas said in a statement.

It was the second time this week DMX, who rose to fame with hard-core rap songs and hit albums like "It's Dark and Hell is Hot," has run afoul of Arizona authorities.

On Tuesday, state police arrested him for driving at speeds as high as 114 miles per hour (183 kph) on a freeway.

Police first raided his home in the Cave Creek community near Phoenix last August. They found 12 distressed pit bulls and three dead animals partially buried on the property as well as a number of firearms.

An indictment was issued on seven counts of animal cruelty after the August raid. Police staged Friday's raid to arrest DMX on charges from their initial investigation. This time, they also found unspecified illegal drugs and five more pit bull puppies, which they removed from the house.

Said Sheriff Joe Arpaio: "With all his money and fame, (DMX) has no excuse for not providing proper care for his animals."

DMX pleaded guilty in New Jersey to animal cruelty charges in 2002 for neglecting some 13 pit bulls, according to news reports. As part of his sentence, he was required to make a public service announcement against animal abuse.

He has also faced previous charges of possession of marijuana and assault.

The rapper has sold more than 20 million albums. The cover art for one of his recent CDs, "Year of the Dog ... Again" depicts him restraining a snarling pit bull on a chain.

While he is best known as a rapper, DMX also has acted in several movies including "Romeo Must Die" and "Exit Wounds."

Rapper DMX was arrested for the second time in a week Friday, this time after he was indicted on felony drug possession and misdemeanor animal cruelty charges.

A SWAT team with the Maricopa County Sheriff's Office raided DMX's north Phoenix home at about 3 a.m. to serve arrest and search warrants and take him into custody on the indictment, sheriff's spokesman Capt. Paul Chagolla said.

DMX, whose real name is Earl Simmons, tried to barricade himself in his bedroom as a SWAT team entered but then came out.

He made an initial court appearance Friday where bail was sent at $7,500, said his local attorney, Cameron Morgan. Morgan said he expected bail to be posted quickly. fuming mad fuming mad

The indictment stems from an August search of the rapper's home prompted by reports of dogs being abused on his property. Detectives seized 12 pit bull dogs and dug up the remains of three others on the rural property.

Detectives also said they found marijuana.

Deputies with the Maricopa County sheriff's office raided the Cave Creek, Arizona, home of rapper DMX on Friday morning (August 24), and according to a police spokesperson, 12 pit bulls were removed from the residence, all in bad condition. Police would not get into specifics but did say the animals are being tended to by veterinarians.

At this point, DMX (real name: Earl Simmons) has not been officially charged with any crime, but police are still investigating. DMX was not at his home at the time of the raid, during which police also discovered a large cache of weapons. Police do not believe the rapper is in Arizona but would like to question him as part of their investigation.

A tipster notified police more than a week ago that dogs were being kept in inhumane conditions at the rapper's property, Maricopa County Sheriff Joe Arpaio told MTV News. "They weren't getting proper food, they weren't getting proper water, and they were tied outside in 115-degree heat," Arpaio said. "We are developing the investigation." He added that the department is seeking additional warrants to check the guns to determine if "they're legal, if he's allowed to have weapons."

According to Arpaio, the charred remains of at least one dog were recovered from DMX's backyard, and the sheriff's department will be investigating the rapper's possible involvement in illegal dogfighting. Police continue to explore the grounds around DMX's home for more dog remains.

The rapper's attorney, Stacey Richman, defended her client, saying, "He loves and lives for his animals" and "has caretakers for his homes and especially for his animals." According to Richman, "The caretaker [DMX had hired] was only coming in once a day. Of course, that was not the arrangement."

This isn't the first time police have taken an interest in DMX's dogs. Back in 2002, the rapper pleaded guilty in New Jersey to charges of animal cruelty, stemming from a 1998 raid of DMX's home. Police claimed he had neglected 13 pit bulls. He eventually plea-bargained down to fines, probation and community service, and even starred in a public-service announcement against animal abuse.

The DMX news comes the same day that NFL star Michael Vick admitted his own involvement with dogfighting (see "Why Does The Michael Vick Case Hurt Hip-Hop?"). The Atlanta Falcons quarterback told the U.S. District Court in Richmond, Virginia, that he would plead guilty to "conspiracy to travel in interstate commerce in aid of unlawful activities and to sponsor a dog in an animal fighting venture." Vick faces a maximum term of five years in prison and $250,000 in fines. Later Friday evening, NFL Commissioner Roger Goodell announced that Vick has been suspended from the league indefinitely.

After a seven-month investigation into the discovery of a dozen malnourished pit bulls and a large weapons cache at DMX's Cave Creek, Arizona, home back in late August, the rapper has been formally indicted on seven misdemeanor counts of animal cruelty and four felony drug possession charges, according to the Maricopa County sheriff's office.

A search warrant for his home was executed just before 3 a.m. on Friday morning (May 9), during which detectives seized even more weapons and drugs, which ultimately led to the filing of an additional drug possession charge. Police removed five pit bull puppies from the rapper's home and took them to a nearby prison, where they will be cared for by female inmates.

According to police, DMX (born Earl Simmons) attempted to barricade himself in his bedroom when police arrived to detain him, but he was eventually talked into coming out and offered no further resistance. He was brought to a nearby jail, where he was booked and processed.

The charges stem from an August 24 raid, during which police removed 12 pit bulls from DMX's home and unearthed a collection of weapons. Maricopa County Sheriff Joe Arpaio told MTV News that the dogs "weren't getting proper food, they weren't getting proper water, and they were tied outside in 115-degree heat." Until now, DMX had not been charged with a single crime related to that incident.

In August, police also discovered the charred remains of at least one dog, after digging up portions of DMX's backyard. Detectives at the time said they'd be investigating the rapper's possible involvement in illegal dogfighting.

"A guy like this DMX character, with all his money and fame, has no excuse for not providing proper care for his animals," Arpaio said in a press release about Friday's arrest. "He has a long criminal history and obviously has little or no respect for the law."

District Attorney Andrew Thomas will be leading the prosecution of DMX, and said his office did not deliberately go after the rapper to send a message to others.

"A person's celebrity status does not preclude this office from bringing charges," he said. "We are handling this case as we would any other indictment of alleged animal cruelty."

Police are also searching the Mayo Clinic in Scottsdale, Arizona, exploring a potential fraud scheme involving Simmons. The sheriff's office declined to discuss that matter further.

This is the second time this week DMX has been arrested by authorities in Arizona. On Tuesday, the rapper was arrested by officers from the Arizona Department of Public Safety on charges of racing on a highway, driving on a suspended license, reckless driving, two counts of endangerment and three counts of criminal speed, all stemming from an incident that took place January 21. Stationary traffic cameras positioned along the Loop 101 freeway in Scottsdale, Arizona, captured DMX driving a bright yellow 1966 Chevy Nova II (with a large "DMX" decal emblazoned across the windshield) well over the posted 65 mph speed limit, not once but three times.

CAVE CREEK, AZ -- Rapper DMX was arrested early Friday by a Maricopa County Sheriff's Office tactical team after trying to barricade himself in a bedroom.

During the 3 a.m. search, a number of weapons and drugs were seized, resulting in additional drug possession charges.

After he briefly barricaded himself, DMX came out and offered no resistance to deputies.

He was booked into the Fourth Avenue Jail and faces a Grand Jury Indictment May 15.

In addition, Sheriff’s deputies are right now serving a search warrant at the Mayo Clinic near 56 Street and Mayo Drive in Scottsdale.

The search could be linked to a potential fraud scheme involving the rapper. No further details are available at this time.


Friday morning's arrest stems from an investigation that began last summer after deputies found at least a dozen malnourished and dehydrated pit bulls at his home.

Five more pit bull-mix dogs were found in the home when the rapper was arrested Friday.

They were taken by Sheriff’s animal cruelty unit specialists to the First Avenue Jail where they will remain under the care of female inmates.

After the seven-month-long investigation, Maricopa County Sheriff Joe Arpaio said DMX, whose real name is Earl Simmons, has been indicted on seven misdemeanor counts of animal cruelty and four felony drug possession charges.

Simmons, 37, was investigated by the Sheriff’s Office after a number of complaints came in concerning neglected animals on his property near 7th Street and Carefree Highway, north of Phoenix.

After attempts to contact Simmons failed, Sheriff’s detectives obtained a search warrant on the address in August 2007.

Twelve dogs, pit bull mixes, were removed and taken to an emergency veterinarian where they were treated for malnutrition and dehydration.

The remains of three other dogs were found partially buried on the property. One of the dogs may have been burned.

Inside the home, detectives found drugs, drug paraphernalia, weapons and ammunition.

“He has a long criminal history and obviously has little or no respect for the law,”
Arpaio said.

County Attorney Andrew Thomas, whose office will prosecute DMX, considers animal cruelty charges as serious violations of the law as well.

“A person’s celebrity status does not preclude this office from bringing charges against a defendant. We are handling this case as we would any other incident of alleged animal cruelty,” Thomas said.

Simmons' New York lawyer, Murray Richman, said he told his client to expect such a raid after his efforts to make DMX available to law enforcement were rebuffed.

"I anticipated it, I explained to my client what was going to happen," Richman said. "I think that the animal cruelty is not going to be able to be established and I think that this is Sheriff Joe's moment."

Simmons was also arrested earlier this week after being caught driving 114 mph by speed cameras in north Scottsdale.

Autopsy reports detail injuries to rapper DMX dogs

Newly released reports show three dogs found buried in the backyard of rapper DMX’s Cave Creek home all had injuries.

Skeletal and necropsy exams found one of the dogs had been burned. It also had fractures on a right shoulder and wounds to the right legs consistent with severe dog bites.

Another dog had blunt force trauma to a shoulder and trauma to the chest and abdomen.

A third dog had injuries to his lower right leg consistent with severe dog bites.

Maricopa County Sheriff's investigators found the dogs buried in shallow graves in August after getting an anonymous complaint to the sheriff’s office animal cruelty complaint hotline.

"These dogs were not in good shape when we shipped them to the doctor," said Maricopa County Sheriff Joe Arpaio.

Sheriff records show deputies also seized 12 dogs left outside without food or water in 110 degree temperatures. A deputy noted several of the dogs looked considerably underweight.

Records indicate the rapper hired Bradley Blackwell to watch over the dogs. When investigators came out to the house, Blackwell told investigators about the buried dogs.

Blackwell also told investigators he had to separate four of the other dogs to prevent them from fighting with each other.

At this point, no one has been charged with anything.

Deputies also found drugs and several guns at the home.

The sheriff said the investigation is on-going but adds someone will be arrested.

He’s just not sure who yet.

Sarge - I don't know what the right word is to describe this monster, but he's certainly brazen.

13-2910. Cruelty to animals; interference with working or service animal; classification; definitions

A. A person commits cruelty to animals if the person does any of the following:

1. Intentionally, knowingly or recklessly subjects any animal under the person's custody or control to cruel neglect or abandonment.

2. Intentionally, knowingly or recklessly fails to provide medical attention necessary to prevent protracted suffering to any animal under the person's custody or control.

3. Intentionally, knowingly or recklessly inflicts unnecessary physical injury to any animal.

4. Recklessly subjects any animal to cruel mistreatment.


5. Intentionally, knowingly or recklessly kills any animal under the custody or control of another person without either legal privilege or consent of the owner.

6. Recklessly interferes with, kills or harms a working or service animal without either legal privilege or consent of the owner.

7. Intentionally, knowingly or recklessly leaves an animal unattended and confined in a motor vehicle and physical injury to or death of the animal is likely to result.

8. Intentionally or knowingly subjects any animal under the person's custody or control to cruel neglect or abandonment that results in serious physical injury to the animal.

9. Intentionally or knowingly subjects any animal to cruel mistreatment.

10. Intentionally or knowingly interferes with, kills or harms a working or service animal without either legal privilege or consent of the owner.

11. Intentionally or knowingly allows any dog that is under the person's custody or control to interfere with, kill or cause physical injury to a service animal.

12. Recklessly allows any dog that is under the person's custody or control to interfere with, kill or cause physical injury to a service animal.

13. Intentionally or knowingly obtains or exerts unauthorized control over a service animal with the intent to deprive the service animal handler of the service animal.

B. It is a defense to subsection A of this section if:

1. Any person exposes poison to be taken by a dog that has killed or wounded livestock or poison to be taken by predatory animals on premises owned, leased or controlled by the person for the purpose of protecting the person or the person's livestock or poultry, and the treated property is kept posted by the person who authorized or performed the treatment until the poison has been removed, and the poison is removed by the person exposing the poison after the threat to the person, or the person's livestock or poultry has ceased to exist. The posting required shall provide adequate warning to persons who enter the property by the point or points of normal entry. The warning notice that is posted shall be readable at a distance of fifty feet, shall contain a poison statement and symbol and shall state the word "danger" or "warning".

2. Any person uses poisons in and immediately around buildings owned, leased or controlled by the person for the purpose of controlling wild and domestic rodents as otherwise allowed by the laws of the state, excluding any fur-bearing animals as defined in section 17-101.

C. This section does not prohibit or restrict:

1. The taking of wildlife or other activities permitted by or pursuant to title 17.

2. Activities permitted by or pursuant to title 3.

3. Activities regulated by the Arizona game and fish department or the Arizona department of agriculture.

D. A peace officer, animal control enforcement agent or animal control enforcement deputy may use reasonable force to open a vehicle to rescue an animal if the animal is left in the vehicle as prescribed in subsection A, paragraph 7 of this section.

E. A person who is convicted of a violation of subsection A, paragraph 6 or 10 of this section is liable as follows:

1. If the working or service animal was killed or disabled, to the owner or agency that owns the working or service animal and that employs the handler or to the owner or handler for the replacement and training costs of the working or service animal and for any veterinary bills.

2. To the owner or agency that owns a working or service animal for the salary of the handler for the period of time that the handler's services are lost to the owner or agency.

3. To the owner for the owner's contractual losses with the agency.

F. An incorporated city or town or a county may adopt an ordinance with misdemeanor provisions at least as stringent as the misdemeanor provisions of this section.

G. A person who violates subsection A, paragraph 1, 2, 3, 4, 5, 6, 7 or 12 of this section is guilty of a class 1 misdemeanor. A person who violates subsection A, paragraph 8, 9, 10, 11 or 13 of this section is guilty of a class 6 felony.

H. For the purposes of this section:

1. "Animal" means a mammal, bird, reptile or amphibian.

2. "Cruel mistreatment" means to torture or otherwise inflict unnecessary serious physical injury upon an animal or to kill an animal in a manner that causes protracted suffering to the animal.

3. "Cruel neglect" means to fail to provide an animal with necessary food, water or shelter.


4. "Handler" means a law enforcement officer or any other person who has successfully completed a course of training prescribed by the person's agency or the service animal owner and who used a specially trained animal under the direction of the person's agency or the service animal owner.

5. "Service animal" means an animal that has completed a formal training program, that assists its owner in one or more daily living tasks that are associated with a productive lifestyle and that is trained to not pose a danger to the health and safety of the general public.

6. "Working animal" means a horse or dog that is used by a law enforcement agency, that is specially trained for law enforcement work and that is under the control of a handler.

After a seven-month investigation, Maricopa County Sheriff's deputies arrested rapper DMX at his Cave Creek home early Friday morning on suspicion of misdemeanor animal cruelty and felony drug possession.

The arrest stems from a raid that deputies made on the rapper's home in August, which led to the seizure of 12 allegedly malnourished dogs and the discovery of three more dogs buried in the backyard.

The popular rapper tried to barricade himself in his bedroom while the search warrant was being served, but he eventually emerged, authorities said. He was booked into Fourth Avenue Jail on a $7,500 bond.

He is scheduled to appear in court on May 15.

Sheriff Joe Arpaio said the arrest was delayed because it took months for labs to conduct tests on the animals to confirm they weren't being properly cared for.

Lawyers for DMX, whose real name is Earl Simmons, claimed the rapper was not at home during the August raid and wasn't aware of the dogs' condition.

His lawyers also said that a neighbor was caring for the dogs. But the caretaker said at the time that he did not receive enough money to buy dog food, and could not afford to continue feeding them.

“This was a tough case,” Arpaio said. “We were not in a rush; we put a lot of time on it but you don't rush into an investigation.”

Deputies on Friday also confiscated marijuana that appeared to be packaged for sale, drug paraphernalia and weapons, according to a court document.

Meanwhile, Arpaio said deputies served a search warrant Friday at the Mayo Clinic, 56th Street and Mayo Boulevard in Phoenix, in connection with a potential fraud scheme involving the rapper.

Arpaio said deputies asked for records related to the alleged fraud.

But Lynn Closway, a Mayo Clinic spokeswoman, said the hospital “has no knowledge of anyone being served today, and if Mayo did know and it involved a patient or employee, it would be unable to comment.”

Arpaio said deputies on Friday took from the musician's house five pit bull puppies that will be cared for by inmates. Arpaio added that he was surprised that Simmons still had dogs at his home.

“He had to know that we were still investigating him,” Arpaio said.

In a 1999 case in Teaneck, N.J., Simmons was convicted of animal cruelty involving 13 pit bull puppies that were kept in small cages even as they outgrew the tight space. As part of a plea deal, Simmons made a public-service announcement condemning animal cruelty.

The rapper has had several run-ins with the law in the last few days. Earlier this week, he was arrested and booked on criminal speeding charges. Authorities say photo enforcement cameras in late January recorded his speed at 114 mph on the Loop 101 and Cactus Road in Scottsdale.

Arpaio said Simmons had also recently been cited by deputies in Cave Creek for reckless driving and carrying a weapon in a public park. Charges are pending.

Simmons' adobe-style house, where the search was conducted, is on a barren lot along a rutted, washed-out, dead-end dirt road.

A few cars sat outside the home Friday, and three men milled about, two riding an all-terrain vehicle.

A neighbor, who wouldn't identify himself, described Simmons as friendly enough. He waves as he goes by on his quad, the neighbor said. However, sometimes Simmons speeds across property and the neighbor said he has asked him to slow down. Simmons complied.

“I was surprised to hear about the dogs, you can hear everything at night out here,” he said.
